Update: Former Area Couple Win Judgement in Lawsuit Against Former Business Partners

Another court ruling has gone against an area couple facing several charges of fraud over the last decade.

As detailed in reports posted earlier this year, Brian Sides of Branson has faced numerous charges in cases of fraud in both southern Missouri and northern Arkansas. Some of the charges are against him individually and others have included his wife Stacy including the dispute between him and Duane and Stephanie Smith, who now live in the Mountain Home area but formerly resided in Stone County. When the Smiths moved to the Mountain Home area, the Sides approached them about partnering for the Whispering Oaks Luxury RV Park, a project that a lawsuit filed by the Smiths claim that Brian and Stacy Sides abandoned in 2023 leaving the Smiths to deal with the project that had already cost them thousands of dollars. 

In the judgement filed in Baxter County Circuit Court earlier this month, the judge dissolves the agreement for the Park and gives Duane and Stephanie Smith complete authority to dissolve and liquidate Whispering Oaks Luxury RV Parks, LLC as well as monetary judgement at around $334,000. 

This is one of many issues that have faced Brian and Stacey Sides dating back to accusations of fraud in construction agreed to after the Joplin Tornado in 2011. Sides has also faced charges in in writing hot checks in Arkansas.
